NOTICE OF NEED TO PROVIDE PRODUCT WARNINGS UNDER CALIFORNIA PROPOSITION 65

In California, the Safe Drinking Water & Toxic Enforcement Act of 1986, commonly known as Proposition 65 (“Proposition 65”), establishes a list of chemicals which the State of California’s risk assessment process has determined present a risk of cancer, birth defects or other reproductive harm.  For reference, the Proposition 65 chemical list can be found at: http://www.oehha.ca.gov/prop65/prop65_list/files/P65single01032014.pdf. Proposition 65 requires that certain warnings be provided in connection with the sale, or advertising for sale, of consumer products which may result in exposure to one or more of the chemicals listed in Proposition 65. This Notice is being provided to inform you that products produced by Continental Refrigerator contain Vinyl Chloride, which is a chemical listed in Proposition 65.  Because the materials in our products may result in exposure to these chemicals, Proposition 65 requires that the specific warnings described in this Notice are to be provided in connection with the sale or advertisement for sale, of any products in California.

Requirements for On-Product Warnings

Proposition 65 requires that warning symbols and statements be placed directly on the packaging for the products.  National Refrigerator and Air Conditioning Products, Inc.(NRAC) will be using the following warning statement on all Continental products:

WARNING: This product can expose you to Vinyl Chloride, which is known to the State of California to cause cancer. (For more information go to www.p65warnings.ca.gov)

Requirements for Internet, Catalog, and Other Print Advertisements

Proposition 65 also applies to consumer products that are sold, or advertised for sale, on the internet, in catalogs, or in other print advertisements.  Proposition 65 provides that the warnings provided on a website or in a catalog or print advertisement may consist of the same content as an on-product warning that complies with Proposition 65.  Thus, the on-product warnings described above must be included on any website, catalog, or print advertisement that offers for sale Continental Refrigerator products which are supplied by NRAC. Please be advised that the distributor / dealer is responsible for placing either the warning described in this Notice on any products that the distributor / dealer obtains from NRAC for sale in California. The distributor / dealer is also responsible for placing the warning described in this Notice on any website, catalog, or print advertisement of the distributor / dealer which offers for sale any products which are supplied the distributor / dealer by NRAC. If the product warning information changes do to the change of product materials you will be notified of the changes along with the warning statement.
